Terms of Service - LumenFrame Studio Singapore

1. Introduction and Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the services provided by LumenFrame Studio Singapore ("we", "us", "our"), a photo-studio business operating in Singapore. By booking, purchasing, accessing, or using any of our services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our services.

These Terms apply to all clients, customers, participants, guests, and any other persons who engage with our services, whether in person, online, by email, by telephone, or through any booking platform.

2. Scope of Services

LumenFrame Studio Singapore provides professional photography services, which may include:

  • Professional portrait photography
  • Corporate headshots
  • Product photography for e-commerce
  • Family and maternity photo sessions
  • Event and milestone photography
  • Personal branding content shoots

The exact scope, deliverables, session duration, location, number of edited images, turnaround time, and any additional services will be confirmed in the applicable quotation, booking confirmation, invoice, or written agreement.

We reserve the right to refuse service, reschedule, or terminate a session where necessary for safety, legal compliance, operational reasons, or inappropriate conduct.

3. User Obligations and Responsibilities

By engaging our services, you agree to:

  • Provide accurate, complete, and current information at all times.
  • Ensure that all persons attending a session have the necessary consent to be photographed or recorded.
  • Obtain all required permissions, releases, permits, venue approvals, and access rights for the shoot location, unless otherwise agreed in writing.
  • Arrive on time for scheduled sessions and cooperate reasonably with our photographers and staff.
  • Follow all studio rules, safety instructions, and reasonable directions given by our team.
  • Ensure that children, dependents, guests, and property under your care are supervised at all times.
  • Not bring illegal, hazardous, offensive, or prohibited items into the studio or shoot location.
  • Not engage in abusive, harassing, discriminatory, threatening, or disruptive conduct.
  • Be responsible for any damage caused by you, your guests, or persons under your control to our equipment, premises, or property.

You acknowledge that photography sessions may be affected by weather, lighting, venue restrictions, crowd conditions, or other factors outside our control, and you agree to cooperate in reasonable adjustments where necessary.

4. Payment Terms and Conditions

All fees, package prices, add-ons, taxes, and charges will be communicated before confirmation of the booking unless otherwise stated. Unless expressly agreed in writing, prices are quoted in Singapore Dollars (SGD).

  • A deposit or full payment may be required to secure a booking.
  • Bookings are only confirmed upon receipt of the required deposit or full payment, as applicable.
  • Any balance due must be paid by the due date stated in the invoice or booking confirmation.
  • Late payments may result in suspension of services, delayed delivery, or cancellation of the booking.
  • We may charge administrative fees, reasonable collection costs, or interest on overdue amounts to the extent permitted by law and as disclosed in writing.
  • Any bank charges, payment gateway fees, currency conversion fees, or similar charges imposed by third parties are your responsibility unless we agree otherwise.

Unless otherwise stated, all payments are non-cash refundable and must be made using the payment methods accepted by us from time to time. We reserve the right to withhold delivery of final images, products, or files until all outstanding amounts are paid in full.

5. Cancellation and Refund Policy

Cancellations and rescheduling requests must be made in writing by email or through any other channel we designate. The following general policy applies unless a different policy is stated in your booking confirmation or written agreement:

  • If you cancel more than 7 days before the session, any refund or credit will be determined based on the package terms and any non-recoverable costs already incurred.
  • If you cancel within 7 days of the session, the deposit may be forfeited.
  • If you cancel within 48 hours of the session or fail to attend, the full session fee may be forfeited.
  • Rescheduling is subject to availability and may incur an administrative fee if requested close to the session date.
  • Refunds are generally not provided for change of mind, dissatisfaction arising from subjective preferences, or where services have been substantially performed.

If we must cancel or materially reschedule a session due to reasons within our control, we will use reasonable efforts to offer an alternative date or a refund of the affected portion of fees paid, at our discretion and subject to applicable law.

For product photography and deliverables involving printed goods, digital files, or custom work, no refund will be provided for errors or delays caused by inaccurate information, late approvals, or failure to provide required materials on time.

6. Liability Limitations

To the fullest extent permitted by Singapore law, LumenFrame Studio Singapore shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, loss of business, loss of goodwill, or loss of data, arising out of or in connection with our services.

Our total aggregate liability for any claim arising from or relating to the services shall be limited to the amount paid by you for the specific service giving rise to the claim, except where such limitation is prohibited by law.

We are not responsible for:

  • Acts, omissions, or negligence of third parties, including venues, vendors, models, stylists, makeup artists, transport providers, or event organisers.
  • Delays, interruptions, or failures caused by equipment malfunction, power failure, internet issues, weather, or other circumstances beyond our reasonable control.
  • Loss or damage to personal property brought to the studio or shoot location, except to the extent caused by our proven negligence and as required by law.
  • Any dissatisfaction based on style, artistic judgment, composition, editing choices, colour grading, or other creative decisions made in good faith.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence where such exclusion is not permitted.

7. Intellectual Property Rights

Unless otherwise agreed in writing, all intellectual property rights in photographs, edited images, previews, contact sheets, videos, graphics, and other creative outputs produced by LumenFrame Studio Singapore remain our property until full payment has been received.

Upon full payment, you are granted a non-exclusive, non-transferable, non-sublicensable licence to use the final delivered images for the purposes agreed in the booking or invoice, subject to any restrictions we specify.

You must not:

  • Alter, crop, filter, edit, or manipulate delivered images in a way that misrepresents our work or damages our reputation, unless we consent in writing.
  • Remove watermarks, metadata, copyright notices, or attribution where applicable.
  • Sell, license, distribute, or commercially exploit images beyond the agreed scope without our prior written consent.

We may, unless you object in writing before the session or unless otherwise agreed, use selected images for our portfolio, website, social media, advertising, studio displays, competitions, and promotional materials, subject to applicable law and any consent requirements.

Where images include third-party rights, trademarks, copyrighted materials, or identifiable persons, you are responsible for obtaining the necessary permissions unless we expressly agree otherwise in writing.

8. Data Protection and Privacy

We are committed to handling personal data in accordance with the Singapore Personal Data Protection Act 2012 ("PDPA") and applicable privacy laws.

By engaging our services, you consent to our collection, use, disclosure, storage, and processing of personal data for purposes including:

  • Managing bookings, payments, and customer accounts
  • Providing photography services and delivering outputs
  • Communicating with you about your booking, enquiries, or after-sales support
  • Maintaining business records, accounting, and legal compliance
  • Marketing, portfolio, and promotional use where permitted by law and consented to where required
  • Preventing fraud, abuse, and unauthorised access

We may share personal data with trusted service providers, contractors, payment processors, cloud storage providers, delivery partners, or other third parties where necessary to provide our services or comply with legal obligations.

You are responsible for ensuring that any personal data you provide to us, including data relating to third parties, has been collected and disclosed lawfully and with the necessary consent where required.

9. Force Majeure

We shall not be liable for any delay, failure, or inability to perform our obligations where such delay or failure is caused by events beyond our reasonable control, including but not limited to acts of God, fire, flood, storm, epidemic, pandemic, public health restrictions, war, civil unrest, terrorism, labour disputes, power outages, government action, venue closure, transport disruption, or equipment shortages.

In such circumstances, we may, at our discretion, reschedule the service, modify the scope, provide a substitute arrangement, or cancel the affected service with a refund or credit of the unused portion, subject to applicable law and any non-recoverable costs already incurred.

10. Changes to Terms

We may update, amend, or replace these Terms from time to time to reflect changes in our business practices, services, legal requirements, or operational needs.

The updated Terms will take effect when posted on our website or otherwise communicated to you, unless a later effective date is stated. Your continued use of our services after the effective date of the updated Terms constitutes acceptance of the revised Terms.

11. Applicable Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Singapore.

Any dispute arising out of or in connection with these Terms, or the services provided by LumenFrame Studio Singapore, shall be subject to the exclusive jurisdiction of the courts of Singapore, unless otherwise required by applicable law or agreed in writing.

13. Severability Clause

If any provision of these Terms is found by a court or competent authority to be invalid, unlawful, or unenforceable, that provision shall be severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

Where possible, any invalid or unenforceable provision shall be replaced by a valid provision that most closely reflects the original intent of the parties and the commercial purpose of these Terms.
